Montmar Beverages Ltd ("Montmar", "we", "us", "our") respects the privacy of every founder, brand owner, supplier, and visitor who interacts with us. This policy explains what personal information we collect through this website and our project intake process, how we use it, and the rights you have under the Nigeria Data Protection Regulation (NDPR) 2019 and the Nigeria Data Protection Act 2023.

By submitting a project brief or otherwise sharing personal information with us, you consent to the practices described here.

Information we collect

We only collect information you actively provide. That typically includes:

• Identity data name, role, and the legal entity you represent
• Contact data email address and, optionally, phone number
• Project data beverage category, target volume, project stage, and any free-text notes you include in your brief
• Technical data basic server logs (IP address, user agent, referrer) retained for security monitoring

We do not collect payment information through this site, and we do not buy lists or enrich your data from third-party brokers.

How we use information

We use your information for these purposes only:

• To respond to your project brief and prepare a costing or timeline
• To negotiate, execute, and perform contracts you enter into with us
• To send transactional updates relating to an active engagement
• To meet record-keeping obligations under Nigerian tax, NAFDAC, and SON regulations
• To protect our facility, staff, and systems from fraud and security threats

We do not use your information for direct marketing without your separate, opt-in consent.

Sharing with third parties

Your information stays within Montmar except where sharing is necessary for an engagement you have authorised, or where we are legally compelled to disclose. The limited categories of recipient are:

• Regulatory bodies (NAFDAC, SON, FIRS) where filings on your behalf require it
• Logistics, ingredient, and packaging suppliers strictly to the extent required to fulfil your production order
• Our professional advisers (legal, audit, insurance) under confidentiality obligations
• Law enforcement or courts in response to a valid legal process

We do not sell, rent, or trade your personal information to anyone.

Cookies and tracking

This website uses only essential, first-party storage required for navigation. We do not run advertising trackers, behavioural profilers, or cross-site analytics on this site. If we add a privacy-respecting analytics tool in future, this policy will be updated and a notice will appear at first visit.

Data security

Information you submit is transmitted over TLS and stored on access-controlled systems within Nigeria or the European Economic Area. Access is limited to Montmar staff with a defined need, governed by written confidentiality undertakings. We test our systems and processes regularly and notify the Nigeria Data Protection Commission and affected individuals within 72 hours of any breach that creates a high risk to rights and freedoms, in line with NDPR requirements.

Your rights

Under the NDPR and the Nigeria Data Protection Act, you have the right to:

• Access the personal information we hold about you
• Request correction of inaccurate information
• Request erasure where the legal basis for processing has ended
• Withdraw consent at any time, where consent is the basis
• Object to processing or request a restriction
• Lodge a complaint with the Nigeria Data Protection Commission

Data retention

Project briefs are retained for the duration of any subsequent engagement plus six years for tax and regulatory compliance. Briefs that do not become an engagement are deleted within 24 months of last contact. Server logs are retained for 90 days.

Changes to this policy

We may update this policy as our services evolve or the law changes. The effective date at the top of the page reflects the latest version. Material changes are notified by email to anyone with an active engagement.

Acceptance of terms

These Terms of Service ("Terms") govern your use of montmar.ng and any project intake or correspondence that arises from it. By using the site or submitting a project brief, you confirm that you have authority to act for the legal entity you represent and that you accept these Terms.

Use of this site

You may browse and reference this site for legitimate commercial enquiry. You may not:

• Reproduce content except for personal, non-commercial reference
• Probe, scan, or test the vulnerability of the site or attempt to circumvent security
• Use automated means to scrape or harvest content or contact data
• Submit briefs that contain unlawful, defamatory, or misleading content

Project briefs and quotes

A project brief submitted via this site is an enquiry only. It does not create a contract, reserve production capacity, or oblige Montmar to deliver any service. A binding engagement requires a separately signed Production Services Agreement and the receipt of any deposit specified in the quote.

Quotes are valid for 30 days from issue and are based on the inputs you supply. Material changes to volume, format, or specification may require a re-quote.

Confidentiality

Recipes, brand concepts, packaging artwork, and commercial terms shared with us are treated as confidential from the moment of submission, whether or not a non-disclosure agreement is in place. We restrict access to staff and advisers with a defined need and apply the same standard of care we apply to our own confidential information. A separate NDA is available on request and is signed as standard before any sample work begins.

Intellectual property

Background IP brought to a project remains the property of its owner. Recipes you commission with us, including any technical refinement performed by our R&D team specifically for your brand, are assigned to you on full payment of the relevant invoice. Process know-how, pilot-batch tooling, and analytical methods used across our floor remain Montmar's property. Trademarks, brand identities, and the Montmar name on this site remain the property of Montmar Beverages Ltd.

Warranties and disclaimers

This site is provided on an "as is" basis. We aim for accuracy but do not warrant that the content is free of errors, that the site will be available without interruption, or that information shown will remain current. Capabilities, capacities, and lead times described here are illustrative; the figures that govern any engagement are those set out in your individual quote and Production Services Agreement.

Limitation of liability

To the fullest extent permitted by Nigerian law, Montmar is not liable for indirect, consequential, or business-interruption losses arising from your use of this site, including loss of profit, loss of goodwill, or loss of data. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded by law.

Modern slavery statement

Montmar has zero tolerance for forced labour, child labour, debt bondage, and human trafficking. Every member of our staff is hired directly by Montmar, paid at or above the relevant minimum wage, and works hours compatible with Nigerian labour law. We require the same standards of every supplier of ingredients, packaging, and logistics we engage, and we reserve the right of audit. Concerns can be reported in confidence to info@montmar.org.

Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising under or in connection with them shall be referred first to good-faith negotiation between senior representatives of each party, and failing resolution within 30 days, to arbitration in Lagos under the Arbitration and Mediation Act 2023, before a single arbitrator agreed between the parties.
